If you need to make a decision on behalf of a loved one now or in the future, then you need to arrange a Lasting Power of Attorney (LPA) for them. An LPA is the legal document that is used by banks, doctors and other important services to allow you to make decisions for a loved one

What do I have to do to put in place an LPA using the free service

  1. Fill out the Enhanced Living LPA form
  2. Print off the forms that we email to you – FREE of charge
  3. Sign all the documents – there is multiple signatures to complete
  4. Register the LPA by sending the documents to the Office of the Public Guardian – PO Box 16185, Birmingham, B2 2WH

What is the benefit of the Expert Checking Service

If you would like to get your LPA with a certificate of Capacity, which may be required if your loved is showing signs of Dementia. Our Premium Service is a face to face visit and include a certificate of Mental Capacity, which is required to make the LPA legal

What does lacking Mental Capacity mean

People that lack Mental capacity are unable to make decisions for themselves as a result of an illness such as Dementia. It means that the person is;

  • Unable to understand the implication of a certain decision
  • Explain why they have made a decision
  • Consider the pros and cons of a particular decision

Once a person lacks Mental Capacity, then it is not possible for them to put in place a Lasting Power of Attorney.

What happens when a person loses mental capacity , but there is no LPA in place

The only option available is a Deputyship which is long and potentially expensive legal process. The Deputyship is managed by the Court of Protection. Getting in place an LPA whilst it is still possible is the best option most cases.

Can I revoke Lasting Power of Attorney

In short, assuming that you still have Mental Capacity, then you can. The process must be a formal revocation of the Power of Attorney which then means that it is binding.

In the event that your spouse or civil partner has Power of attorney and you subsequently divorce or the marriage is annulled, this automatically revokes Power of Attorney unless other expressly agreed.
